1. Acceptance of Terms

These Terms of Use (“Terms”) govern your access to and use of GoldenHourNow.com, including its planner, maps, forecasts, destination pages, guides, articles, contact form, and related services (collectively, the “Service”). In these Terms, “Golden Hour Now,” “we,” “us,” and “our” refer to the owner/operator of GoldenHourNow.com. By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Changes to the Service & Terms

We may add, modify, suspend, replace, or discontinue features, content, data providers, or parts of the Service. We may also revise these Terms when the Service, its providers, or applicable requirements change. The effective date above will be updated when revised Terms are published, and additional notice may be provided when appropriate. To the extent permitted by law, continued use of the Service after revised Terms take effect means that you accept the revised Terms. If you do not agree, stop using the Service.

3. Eligibility & No Accounts

GoldenHourNow is a general-audience service and is not directed to children under 13. If you are below the age of majority where you live, use the Service only with permission from a parent or legal guardian.

The current production Service does not provide user accounts, login credentials, paid subscriptions, or public profile and photo-upload features. If you submit the contact form, you agree to provide information that is accurate to the best of your knowledge and not to impersonate another person or organization.

4. Acceptable Use

You agree to use the Service lawfully and in a manner that does not harm the Service, its providers, or other people. You may not, and may not attempt to:

• obtain non-public source code, server-side credentials, API keys, private configuration, or proprietary backend logic except as permitted by applicable law;
• bypass security controls, rate limits, access restrictions, consent controls, robots directives, or other technical safeguards;
• use scraping, bots, or other automated means at a volume or in a manner that disrupts the Service, burdens its providers, or violates applicable law or published controls; ordinary search-engine indexing that respects published controls is not prohibited;
• interfere with the Service, probe for vulnerabilities without authorization, introduce malware, or attempt unauthorized access to systems or data;
• submit spam, unlawful material, infringing material, malicious code, or sensitive personal information that is not needed for the requested function;
• misrepresent your identity or affiliation, violate another person’s rights, or use the Service to facilitate unlawful or unsafe conduct.

5. Intellectual Property

GoldenHourNow owns or licenses the original site text, visual design, logos, original diagrams, software, page arrangements, and other site-created materials. Third-party photographs, maps, map data, weather and geocoding data, software libraries, trademarks, and other materials remain the property of their respective owners and may be subject to separate licenses, attribution requirements, and terms.

You may use the public Service and its displayed planning output for ordinary personal or professional planning. Unless permitted by law or by written permission, you may not reproduce or republish substantial portions of the site, remove required credits, repackage or resell site content or data, perform bulk extraction, or use GoldenHourNow branding in a way that suggests sponsorship or endorsement.

6. Messages & Feedback

The current Service does not provide public comments, listings, profiles, or photo uploads. If you submit a message through the contact form, you authorize GoldenHourNow and its form and email providers to process and deliver the message for the purposes of responding, maintaining correspondence records, preventing abuse, protecting the Service, and complying with legal obligations. You retain any rights you have in the content of your message.

You represent that you have the right to submit the material and that it does not violate law or another person’s rights. Do not submit confidential business information, trade secrets, passwords, financial information, government identifiers, health information, or other sensitive material unless GoldenHourNow has expressly agreed in advance to receive it.

If you voluntarily provide a suggestion or other non-confidential feedback about the Service, GoldenHourNow may consider and use that feedback to improve the Service without an obligation to compensate you. Personal information contained in a message remains subject to the Privacy Policy.

7. Third-Party Services & Links

The Service relies on or links to third-party providers, which may include hosting and content-delivery services, maps and place search, weather data, analytics, advertising and consent systems, software-library delivery, form processing, and email delivery. Current providers are described in the Privacy Policy.

Third-party services, data, content, links, availability, and security are controlled by their respective providers and are subject to their own terms and policies. GoldenHourNow does not guarantee that a third-party service will remain available, accurate, unchanged, or suitable for a particular purpose. A link or integration does not by itself mean that GoldenHourNow endorses the provider or all of its content.

8. Planning Information; Accuracy & Availability

The Service provides planning information that may include sunrise and sunset times, golden-hour and blue-hour windows, sun direction, maps, weather context, a seven-day forecast, a photography-planning score, destination information, and educational guidance.

Astronomical results are calculated from the selected coordinates, date, time zone, and published conventions. Weather data, visibility, cloud information, and photography scores are forecast-based planning aids, not guarantees of actual conditions. Terrain, buildings, horizon obstructions, fog, smoke, marine layers, cloud placement, rapidly changing weather, extreme latitudes, incorrect inputs, and provider or network outages can affect the displayed information and the conditions at a location.

Do not rely on GoldenHourNow as the sole source for a safety-critical decision. Independently verify current weather alerts, closures, access hours, permits, local restrictions, aviation or drone rules, emergency information, and conditions at the location. The Service is not a substitute for official weather, emergency, legal, aviation, or site-safety information.

9. Disclaimers

THE SERVICE, INCLUDING THIRD-PARTY DATA AND CONTENT DISPLAYED THROUGH IT, IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLDEN HOUR NOW DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, UNINTERRUPTED, OR AVAILABLE AT A PARTICULAR TIME, OR THAT A FORECAST, SCORE, TIME, DIRECTION, MAP, OR OTHER OUTPUT WILL MATCH ACTUAL CONDITIONS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLDEN HOUR NOW WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

11. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Golden Hour Now from third-party claims, liabilities, damages, losses, and reasonable expenses arising from your unlawful misuse of the Service, your material breach of these Terms, or material you submit that violates law or another person’s rights. This provision does not require you to indemnify Golden Hour Now for liability caused by Golden Hour Now’s own fraud, willful injury, violation of law, or other liability that cannot lawfully be shifted to you.

12. Access Restrictions & Service Changes

GoldenHourNow may rate-limit, block, or restrict access; reject or filter form submissions; remove material submitted through the Service; or modify, suspend, or discontinue all or part of the Service when reasonably necessary for security, abuse prevention, maintenance, legal compliance, provider changes, or operational reasons. Because the current Service has no user accounts, there is no account to terminate. Provisions that by their nature should survive a restriction or discontinuation—including intellectual-property, disclaimer, liability, indemnification, and dispute provisions—will continue to apply.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except where applicable law requires otherwise. Subject to any non-waivable rights or procedures, a dispute arising out of the Service or these Terms may be brought in the state courts located in Ventura County, California, or in a federal court that has jurisdiction over Ventura County. Nothing in these Terms prevents either party from using a court or procedure that applicable law does not permit these Terms to exclude.

14. Privacy

Your use of the Service is subject to the Privacy Policy, which describes location and planner inputs, browser storage, cookies, Analytics, AdSense, consent controls, contact-form submissions, service providers, retention, security, privacy rights, children’s privacy, and international processing.
